Terms of Service

1. Acceptance of Terms

By accessing or using the peek mobile application and related services (the "Service"), operated by Peek Technologies Pty Ltd ("peek," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 18 years of age to use peek. By using the Service, you represent and warrant that you are at least 18 years old. We do not knowingly collect information from or provide services to individuals under 18.

3. Account Registration and Sign-In

To use peek, you must create an account. You can register with an email address and password, or by using Sign in with Apple or Sign in with Google. You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

4. How peek Works

peek helps couples explore intimacy together. You independently swipe through curated cards (activities, questions, fantasies) and react with "Yum" (interested), "Ick" (not interested), or "Maybe" (unsure). When both you and your linked partner swipe "Yum" on the same card, it becomes a match you can explore together.

peek also includes chat with your partner and a range of experiences you use together, such as date night, take a peek, love languages, challenges and swaps. Individual card reactions that do not become a match are not shown to your partner, but content you create in chat and in experiences is shared with your linked partner as part of using those features.

5. Partner Linking and Unlinking

You may link your account with one partner at a time using an invite code or link. By linking with a partner, you consent to sharing matched preferences, messages and shared experience content with them, as described in our Privacy Policy.

To unlink from a partner, delete your account from the app settings or from our account deletion page. Deleting your account ends the partnership link.

6. Your Content and Messaging

You retain ownership of the content you create in peek, such as messages and experience inputs. You grant us a limited license to host, store, transmit and display your content solely to operate and provide the Service to you and your linked partner.

Chat messages between partners are end-to-end encrypted. This means we cannot read the contents of your messages, and we cannot proactively monitor or moderate them. You are responsible for the content you create and share, and you agree not to use peek to create or share content that is illegal or that you do not have the right to share.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, abuse, coerce or harm another person through the Service
  • Share another person's private or intimate content without their consent
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated means (bots, scrapers) to access the Service
  • Impersonate another person or misrepresent your identity
  • Link with a partner without their knowledge or consent

8. Safety, Reporting and Child Protection

You can report abusive behavior or content to us at info@getpeek.io. Because chat is end-to-end encrypted we cannot read message contents, but we can act on reports, including suspending or terminating accounts that violate these Terms. peek has zero tolerance for child sexual abuse and exploitation. 9. Content Shared With a Partner

When you share content with your linked partner, they may be able to view, save or screenshot it. peek cannot prevent this and is not responsible for what your partner does with content you have chosen to share. Please share only what you are comfortable with, and communicate openly about boundaries.

10. Subscriptions and Payments

peek is a paid subscription service. New couples start with a 30 day free trial, and after the trial you keep using peek by subscribing to one of our plans. The plans, their prices and what each one includes are shown in the app and on our pricing page. A plan covers the partnership rather than the person, so only one of you needs to subscribe for peek to be unlocked for both linked accounts.

Subscriptions are sold and billed through the Apple App Store and Google Play, not by us directly. Payment is charged to your store account when you confirm the purchase, and the applicable price, billing period, renewal terms and any trial terms are presented to you before you are charged. Your purchase is also governed by the terms of the store you bought it through, which apply in addition to these Terms.

Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time in the subscription settings of your Apple or Google account. Cancelling stops the next renewal, and your plan stays active for the rest of the period you have already paid for. If we change the price of a plan, the new price applies from your next renewal and never to a period you have already paid for.

Refunds are handled by the store you purchased through and are governed by that store's refund policy, so we cannot issue a refund for a purchase made through the Apple App Store or Google Play. If something has gone wrong with your subscription, contact us at info@getpeek.io and we will help where we can.

11. Intellectual Property

All content, features and functionality of the Service, including text, graphics, logos, icons, images, card content and software, are owned by peek and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our written permission. This does not affect your ownership of the content you create (see Section 6).

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Some processing, including information about your sexual orientation and preferences, is based on your explicit consent.

13. Account Termination

You may delete your account at any time through the app settings or by visiting our account deletion page. Deletion is handled as described in our Privacy Policy.

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to other users or the Service.

14. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

peek is designed to facilitate communication between consenting adult partners. It is not a medical, therapeutic, counseling or health service, and it is not a substitute for professional advice. We are not responsible for the outcomes of any activities or conversations that result from using the Service. Always communicate openly with your partner and respect each other's boundaries.

15. Limitation of Liability

To the fullest extent permitted by law, peek shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of your use of the Service.

16. Your Consumer Law Rights

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under applicable consumer protection law, including the Australian Consumer Law and consumer laws in the European Union and United Kingdom, that cannot lawfully be excluded. Where such a right applies, the disclaimers and limitations above apply only to the extent permitted by that law.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless peek and its officers, employees and agents from any claims, damages, liabilities and expenses arising out of your misuse of the Service, your violation of these Terms, or your violation of the rights of another person, including your linked partner.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Australia. This does not deprive you of the protection of mandatory consumer laws of your country of residence.

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
